Terms of Service

As a customer of Fuzzy-Logic Enterprises, you agree to the following:

  1. Definitions.
    “You”, “Your” refers to you the entity, your agent or legal representative. (Should you require a legal representative, contact information must be submitted and verified prior to your representative acting on your behalf.
    “We”, “Our”, “Us” refers to Fuzzy-Logic Enterprises and any subsidiaries or sister companies (collectively called Fuzzy-Logic Enterprises).
    This is an agreement for Us to You, and for You to Us, and is valid for the full length of the contractual agreement.
  2. Terms – Modification.
    You agree that FLE (Fuzzy-Logic Enterprises) may modify these Terms of Service at any time, and are not required to give any notice prior to these terms changing. Should the terms change halfway through a contractual period, the new terms fall into effect immediately. Should any major changes take place to these terms, you will be notified 24 hours before the changes to these terms are enforced. If the terms should change at any time, we will contact you regarding which term changed, and what the changes are.
  3. Accuracy of Information.
    You agree that the information you provide to us is true, and accurate. If at any time, the information which you provided is to change, you must notify us within 3 working days before the changes are to take place. Should any of the information listed below change, you are required to let us know;

    1. Forename/Surname
    2. Address of Residence
    3. Telephone Contact Numbers
    4. Email Addresses
    5. Payment Information (Including PayPal, Google Checkout and Cheque/Postal Order)
  4. Privacy
    Once your information has been submitted to our system, it is our legal obligation to ensure that your information remains true and accurate. We occasionally request that you check your personal information, and change, or request the change of, any information which is not true or accurate. It is also our legal obligation to ensure that your information remains secure. We have taken many precautionary steps to ensure your data is secure. We also agree that we will not pass on any of your information to any 3rd parties, including/excluding affiliates, subsidiaries and sister companies of Fuzzy-Logic Enterprises.
  5. Prohibited Activities
    The list, which by any means is not exhaustive, below defines activities which are not permitted on any Fuzzy-Logic Enterprise’s server/service.

    1. Attacking an individual, organisation, or community in any way.
    2. Misusing resources by increasing the systems hard disk drive input/output, running processes which use disproportionate amounts of processor time, running processes which use disproportionate amounts of memory.
    3. Using extensive amounts of Networking Resources. We provide you with an Unmetered service as we feel you should not pay for your bandwidth usage, however, using extensive amounts of resources are not permitted.
    4. Using Fuzzy-Logic Enterprises for UBE (Unsolicited Bulk EMail), and by definition means email sent in bulk without the receipt of an intended recipient. Other definitions include (but not limited to):
      1. Sending mail with mangled headers.
      2. Sending mail to subscribed mailing lists. However, if the recipient has willingly signed up to the mailing list, this is acceptable.
    5. Accessing computers or networks without prior authorisation. This includes, but is not limited to, Attempting unauthorized and/or illegal access of computers, networks and/or accounts not belonging to party seeking access. Any act which interferes with the services of another user or network. Any act relating to the circumvention of security measures.
    6. Using Fuzzy-Logic Enterprises to send/receive data which is illegal under the laws of the United Kingdom, The United States of America, or any other country where you, or your business resides. The transmission of illegal media, which includes, but is not limited to, illegal photography/videos of minors, illegal photography/videos of sexual acts (to humans or animals), photography or videos which are owned by someone else, media which you do not have permission to distribute.
    7. Providing false information on any contract or application form, including false Payment information.
  6. Invoicing and Payment
    Invoices will be sent out 5 days prior to the payment being due. Payments are requested on the 15th of every month, except where the service is ordered and accepted after the due date. If the payment is not received four (4) days after the due date, a reminder will be sent. Failure to pay after 7 days will result in a reminder being sent. If a payment is not received after 10 days, late-fee’s will automatically be added to your account. These fee’s must be paid in addition to the total amount due on the invoice. Failure to pay the invoice fifteen (15) days after the due date will result in your account being suspended. Failure to pay after 30 days will result in your account being terminated.
  7. Uptime Guarantee
    Fuzzy-Logic Enterprises agrees to provide an uptime greater than 99.95%. Should the uptime drop below 99.95% for the billing period, you can request prorata credit for your account.
  8. Cancellation and Suspension
    If at any time you wish to cancel your account, you will need to give 10 days notice prior to us closing your account. To request cancellation: Go to your account, then select the “My Services” tab. Next you need to cllick the expand icon on the product you wish to cancel, then finally click “Request Cancellation”. A request will then be sent to our Administrators, who will then process your account. If your account is still owing money, we will not process your cancellation request until all monies are paid in full.
    Should your account reach suspension, you will receive notification two (2) hours before it is suspended. When your account is suspended, you will be locked out of your terminal account, and FTP will also be disabled. We will also point your domains to our account holding pages, which are basic pages explaining that the site is offline. We will never let your customers know your account has been suspended.
    Should Fuzzy-Logic Enterprises need to cancel your account for any reason, we will send notification fifteen (15) days before we cancel it. We reserve the right to cancel any account, at any time, without disclosing a reason.
  9. Law Enforcement
    Fuzzy-Logic Enterprises reserve the right to disclose your information to the respective authorities on presentation of a court order, and we also reserve the right to suspend, or cancel your account on presentation of a valid court order.
